The Health Act 2007 (Care and Welfare Regulations 2009) with Amendments 2010, forms the statutory basis for ensuring that adequate and suitable care and accommodation are provided for dependent persons in private nursing homes. The Nursing Home (Care and Welfare) Regulations, 1993 contained requirements regarding patient safety, staffing levels and record keeping, and also provided for the regular inspection of nursing homes by designated officers of the Health Service Executive.

This remit has now been taken over, and expanded to include the public nursing homes, by the Social Services Inspectorate with the introduction of legislation establishing the Health Information and Quality Authority and the Office of the Chief Inspector of Social Services. As a result specific mandatory safety and quality standards must be met by all nursing homes.
